Suits Against Trustees

Section Section 10 of the Act provides that no suit against a person in whom property has become vested in trust for any specific purpose, or against his local representatives, the purpose of for:

  • 1following trust property; or
  • 2the proceeds thereof, or
  • 3for an account by such property or proceeds, is barred by any length of time.

Any property comprised in a Hindu, Muslim or Buddhist religion or charitable endowment shall be dcerned to be property vested in trust for a specific purpose and the manager of the property shall be regarded as trustee thereof. The provisions are not applicable to assign for valuable consideration from such managers and trustees.

Thus, these rules provide that there shall be no bar of limitation as against an express trustee regarding suits for:
  • 1recovery of trust property; or
  • 2the proceeds thereof, if wrongfully alienated by the trustee.
